In listed securities you need and uptick or a zero tick after an uptick
to sell short(excluding short against the box...but this trade will
probably soon be eliminated by the taxman).  For OTC their are all kinds
of exclusions to the rules that exist for liquid so shorting can be done
at almost any time.

Be real carefull about the short against the box issue....some of the
Proposed language could negatively impact trades made post 05/07/97 and
some are as extreme aas impacting trades made after 01/01/96...go figure
what congress will or won't due.  None the less be careful...be
especially careful about attempting to circumvent the rules...such as
having the long and short in two separate firms.  There is a huge
difference between civil fraud and criminal fraud.    

You can always buy a deep ITM put as a surrogate.  Avoid selling a Deep
ITM call nakedd to attempt to replicate the short..the boys in
Washington have figured that one out already.
