I don't have any doubt that ETS *is* proprietary - you have to look at the whole package, and not the fact that it may be relying on code such as a 21 bar MA which is in the public domain.  When taken together, I have no real doubt that the *system* is a unique work.

I also do not feel that "quoting" it would constitute fair use, as one refers to material from a text, since this could substantially affect "the potential market for or value of" the work.

Now, we may still have reservations about the nature of the work, if it turns out that it is of a quality that even novices could put together with a little work.  Still, though, the author would retain exclusive rights to its publication.
